Gold Medalist explained that they sent the proof of content in an effort to minimize the financial burden on the deceased, stating, “If the company arbitrarily covers the penalty fees that Kim Sae-ron is responsible for, the executives who made this decision could be held liable for breach of trust. There was also concern that the expense might not be recognized as a company loss. Additionally, if the amount loaned to Kim Sae-ron without interest or collateral was not documented through proper procedures, the executives could be accused of granting illegal benefits to a specific individual.”

The agency further elaborated that, during an accounting audit, they had to determine how to handle the receivables related to Kim Sae-ron. They added, “According to legal and accounting firms conducting the audit, if the company wrote off the amount as bad debt without any collection efforts, it would mean the company was unilaterally waiving Kim Sae-ron’s debt, resulting in financial damage to the company. This, too, raised concerns about a potential breach of trust by the executives.”

Regarding this, lawyer Lee Go-eun appeared on YTN News and commented, “If the text messages are not fabricated, it doesn’t seem like the agency was demanding immediate repayment.”

Lee further questioned, “But in reality, how can Kim Sae-ron be held accountable for breach of trust unless the agency files a legal complaint? Isn’t the agency supposed to be the victim in a breach of trust case? However, unless the company itself reports or files charges, it is difficult for the issue of breach of trust to surface.”

Lee continued, “An accountant may need to press for payment and discuss the matter, but the agency claims they sent the proof of content to avoid a breach of trust while considering Kim Sae-ron. However, from a legal standpoint, since a breach of trust case would require the agency to take legal action, I question whether this explanation is truly convincing.”
