Abuse Claims of Former VCHA’s KG May Not be Legally Valid, Said Lawyer

Previously on December 8, KG, a former member of girl group VCHA, filed a lawsuit against JYP USA to terminate her contract with the agency and announced her departure from the group. 

According to KG, under JYP USA, VCHA suffered from inhumane schedules, a suspicious contract and 500,000 USD debt, unreasonable diet and surveillance, health issues, mental and emotional struggles, and abuse and verbal harassment, to the point a member attempted suicide

In response, JYP USA insisted that KG’s accusations contain “false and exaggerated claims” and expressed regrets. 

Now, a lawyer has examined the claims of KG, and concluded that they may not stand in court, though the female idol may have chosen to file the lawsuit for other purposes outside of legal ramifications.

Particularly, in a post titled “A Lawyer’s POV on VCHA KG v. JYP USA Lawsuit and Contract”, which was published on December 10, the author stated that KG’s case is “unlikely to stay in court and will probably never see a jury”.

This is because the case is subject to private arbitration, meaning it may fall under judgement from a former judge or attorney paid to decide cases under different rules from the California Code of Civil Procedure. Additionally, the arbitrator is generally pay in full by the employer (in this case, JYP USA), who will likely want future business from employers, so their decisions may be heavily leaning towards the employers. 

Additionally, the child neglect/endangerment causes of action may not be legally valid, said the lawyer, since JYP will probably successfully argue nobody affirmatively forced LG to do anything and that nobody is entitled to become an idol. 

Nevertheless, the lawyer said that KG might have decided to publicize her lawsuit for different purposes outside of seeking legal consequences. In particular, she may have done that simply to expose JYP’s inhuman clauses, alongside seeking sympathy and justifying her contract termination.
